Get fathers name off of Birth certificate

At the time of my daughters birth we were unmarried,he signed the birth certificate, but she has my last name. HE was abusive,and did nothing for my child. I have since moved out of state and want to have his name removed from the birth certificate. He does not pay child support- nor do I want him too. We haven't heard from him in months,and don't know how to locate him. My fear is that he could find us one day,and demand custody rights. I want him out of our lives forever, how do I go about doing this.

In Georgia, the biological father of a child born out of wedlock does not have legal rights to the child. Although his name is on the birth certificate, this still does not give him legal rights to the child. He has to first file an action for legitimation. Once he files for legitimation, you can then object to it. Until he is granted legitimation, he can not go after you for custody or visitation rights.
