What are a fathers rights to child custody if him and the mother were never married?

If the child is born out of wedlock, then the biological father has no legal rights because he is not the legal father. In order to obtain legal rights, the biological father must file a Paternity Suit asking the Court to declare him to be the legal father and award him custody rights.
