Legal Question in Family Law in Missouri

Hi, yes I have a friend that lives in Missouri, she just left her husband today with her 7 month old baby, she has friends in montana that will take her in but she fears that her husband will considering it kidnapping, what should she do?

A mother may go over state lines with her child. If there is no Court order that directs custody, then she they may legally go without the father. Under the facts you described, the mother woudl nto be guilty of kidnapping, if the father knew how to contact her or the child. However, if she moves to another state without telling the father the whereabouts of the child, it can be used against her in the later Court Order to establish custody and visitation.
