Legal Question in Family Law in Missouri

Full custody Vs. Filing for gaurdianship

4 months ago, my daughter went to visit her grandmother in MO. Grandmohter wouldn't give her back when her visit time was up. Haven't seen her in 4mths now, she is keeping her from me. Now she has filed for gaurdianship for her and the law officers won't help cause she works for them. They say I can't have her until court rules I can at the hearing.(she works for the county) A lawyer I spoke with said she has to give her back at least till the hearing the officers say different and told me lawyers don't always know what they're talking about. Is this true? Does she not have to give her back? Nothing has been heard in front of the judge yet, they keep putting me off, cause I can't afford what lawyers ask for up front and legal aid can't assist at this time. I have tried to get help everywhere, everyone keeps saying I need a lawyer, but I don't have that kind of money up front. What do I do? This gaurdianship was filed for back in August. I need my baby girl back. Please help lead me to someone that can really help. I also want to file a lawsuit on this county for all they have put me through. My rights and my husbands have been totally violated by these officers just cause she works with them. What can I do?

If the prosecutor is attempting to have your parental rights interrupted or terminated, the State must provide legal counsel for you, if you cannot affrod one. You need to contact the Judge's office and the prosecutor's office. You said that the grandmother works with officers, but you did not indicate her position. Also, what County in Missouri is this case in? You also di dnot indicate what events or evidence the grandmother is using to assert a the need for a guardian. What happended? These are some of the first questions a lawyer will need answered. If the grandmother works for the court, or with the judge, then perhaps there is need for a change of judge.
