Legal Question in Family Law in Missouri
Garnishment of wages
Can my wages be garnished by the loan company if in my divorce a court order was issued by the judge that my husband was awarded the truck and any future payments for this truck?

Re: Garnishment of wages
If you were represented by legal counsel in your divorce, you should ask your divorce attorney to explain your rights and duties to you. In order for another attorney to provide competent legal advice in response to your question it would be necessary to review the divorce Decree, Family Court Judgment, Separation Agreement, or whatever other legal documents are in effect. Generally speaking, I handle a substantial number of divorces and it sounds like you signed on a loan which your husband was ordered to pay. The Court Order does not prevent the lender from seeking collection from you since the lender was not a party in your divorce proceedings. Usually, if your husband was not required to refinance, your remedy would be to seek reimbursement from your ex-husband for any money you are compelled to pay on that loan. Please consult with your divorce attorney.
