Legal Question in Family Law in Missouri
My ex girlfriend has moved several times without giving 60 days notice like it said in our parenting plan. the last time was when my daughter was here for the summer and we had to meet her at a store parkinglot so we could follow her to their new apt. She now will not let me talk to my daughter by phone. i have not gotten to speak to mt daughter since before thanksgiving. I call every night and leave a message well tue night when i called her new live in boyfriend picked up the phone and told me not to call here anymore that i will never speak or see my daughter again that she is his daughter now and that he was going to beat me up. well when i called friday they have had the phone number changed. So i called the police to see if they could go and check on my daughter to make sure she was ok. i still can not reach her by phone and our parenting plan states i get her the 1st part of christmas break can that be inforced because i feel she will not show up to drop my daughter off to me. what can i do.

If the child's other refuses to comply withteh custody/vistation order, then you can ask the court to cite her for contempt. You should let the court know about the refusal to allow you to talk to your daughter and the physcial threat from the live-in boyfriend. Custody has been reversed for less that this. If you chalenge the visitation issues apprepriately, you might be able to abate (not pay) child support while the mother is not complying with the visitation order. You should bring all these issues up with the attorney that represented you in the custody case. If you didn't have and attorney then, it may be time to get one.
