Girlfriend's legal status when boyfriend in wanted for child support and leaves
My sister's live-in boyfriend has a warrant issued on him for his arrest after failing to pay child support and failing to show for a court date. My sister has previously testified in court about the situation and is currently living with this man. Now they are talking about fleeing the country.
My sister believes that if they run, she won't be held legally liable for anything he's done and will be able to come and go as she pleases. Is this true or is this a case of aiding and abetting a criminal? We're desperately seeking information that will wake her up to the reality of doing such a thing instead of doing what's right.

If she materially assists him, (pays for ticket, housing, arranges for travel), she is commiting a criminal felony and can be charged. If she merely travels with him but they both pay her own way she is commiting no crime, but from a paractical sense if they are travelling together it will be hard to prove her innocence. Further if they plan an escape route, even if they don't succeed but take steps to flee she can be charged with him for conspiracy.

Although the facts are sketchy ,it seems to me that if your sister has any part in the planning,the financing or anything else related to the proposed flight to avoid prosecution, then she faces criminal responsibility. This is a difficult situation. While it is unlikely she will be prosecuted for her actions, she will be guilty of a series of crimes, several of which are felonies.
The Penal Code includes any number of crimes here - aiding & abetting, conspiracy, contempt, and many others.
If she were charged with 1/2 of the crimes of which she would be guilty then the jain time (consecutive sentences) would likely exceed her life span. of course, she would be parolled after the first 5 years.
It is all very unattractive. Cann a clergyman help?
You can always inform the district attorney of the plans and offer a 'heads up' when he plans to leave on condition that your sister not be charged.
There is no real solution here except your sister regaining her senses. Does this man hit women? He fits the profile.
