Legal Question in Family Law in Missouri

Grandparent rights

My husbands mother is demanding to see our four children. We have not allowed her to see them since the end of Dec. 2006. At that time she was threatening to cut herself or to commit suicide when we didn't have enough time for her. She was also tring to get us to give her a gun to kill her exhusband. She now lives in a group home. She has been diagnoised with bipolar and several other conditions. She has been in and out of hospital for trying to commit suicide. We want to know if legally we can keep our kids from seeing her.

Re: Grandparent rights

The response posted by Penny Umstattd-Cope is right on. If the grandmother has no Court Ordered rights of visitation, then you have every legal right and possibly a lega duty not to allow her unsupervised time with the children.

Re: Grandparent rights

You can deny her visitation with the children. She may try to take you to court but grandparent visitation is extremely limited under your circumstances (no divorce, death, etc. of one of the parents). Based upon the circumstances as you have described, it would appear she is a possible danger to your children and most courts will not order visitation under those circumstances. In fact, based upon what you have described, if you would give her unsupervised visitation and something happened to the children, you could be held to have endangered your children.
