Legal Question in Family Law in Missouri

I have guardianship of my niece who is 4. I went to court when she was 18 months and filed for emergency guardianship and was awarded immediately. My sister, her mother, and her father both agreed in court that her being with me was in her best interest, so they did not appeal it. My sister is now in Oklahoma, the father still lives in the same town, but hasn't provided any support since before I was awarded custody. They also haven't seen her in several months, and even a year for the father. My question is, can this be abandonment in Missouri? I would like their parental rights terminated.

Possibly. But, if they consent to the adoption petition, you won't need to show abandonment. If no adoption petition, then no need to terminate parental rights. You should consult directly with a civil practice attorney in your area.
