Normally either parent can take the chidl with them until teh court issues a custody order. But, when amarried woman has baby, the prewumes her husband is the father. This can be changed by apaternity suit on the opart of the husband or biological father. So, under the facts you described, you can probably take the child with you, unless her husband objects.

Good luck
