Legal Question in Family Law in Missouri
Hello,
I hope you can heLp me. My probblem is a nightmare. My ex ended up with our entire tax refund deposited into his bank account. The refund check was supposed to be mailed in both of our names Not sure how that happened but that is a concern I will address later. When he got the money he made a check out for my half but instead of giving it to me, he wrote his attorneys name of a check & and gave it to him to give to me. Supposedly. Then he said I had to contact his attorney to get my money. Well obviously I cannot do that because He doesn't represent me. I called my attorney everyday for 2 weeks. She kept having her secretary tell me she has not been able to contact the other attorney and she will let me know when she does. I called his lawyers office and they the secretary said they were waiting on my attorney to file an order. They said they couldn't get a hold of her and had proof they had been trying. Then after a week of telling me she hasn't heard back from them she finally has her secretary say she has been in touch with him and she will meet me on Monday. That is another week away. So my question is since i don't owe either attorney any money, I don't owe my ex a dime, and it's my money how is it legal to for the lawyer to hang on to my money. The check was actually cashed by his lawyer as well. My ex has used his half of the refund and mine is being held for a order I no nothing about. My money has been stolen and I need to know if I have any rights here because I feel like I have none. He cut me off financially for almost a year and our 2 kids. I have custody and I just started getting child support from him 2 weeks ago. Please help I have so much to catch up on. Thank you
