Legal Question in Family Law in Missouri

Me and my husband have been fighting for as long as i can remember. In April or May of this year we decided to separate. .We have 3 kids together, age 3,4 and 5. I have been a stay at home mom the entire duration of our 6 year marriage. He wants to do 50/50 custody, exchanging the kids every week with no child support. However, he works 11 hour a day overnights at his job, 5-6 days a week and plans on leaving the kids at home alone with his older children, age 11, 13, and 16. I dont feel like the kids should be left alone over night like that with kids. He says that if I dont agree to that he will get a lawyer and get full custody.

I am worried because starting the end of may i started seeing someone else, nothing serious, only over the phone. Its someone I knew from high school. He knows about it and says he is fine with it as long as he is not around the kids. Could this cause me to lose my case? Am i better off just agreeing to what he says.

As far as child support goes, he says he wont pay anything. He makes $15 an hour, but says he will quit his job and get minimum wage so he doesnt have to pay much. Can he do that? I dont have a job right now because i still watch the kids while he works, which he leaves them with me at 4 pm and gets them at 12 am when he wakes up so it doesnt leave me anytime to work. Does me not having a job right now hurt my case? My mom says she will pay for a lawyer but i want to make sure i have a solid chance of winning first. I dont want to fight him on this and end up losing the kids.

Do not worry. You are not going to lose your kids. And from my experience he has a slim to none chance of getting 50/50, depending upon where you are from. Do not believe anything he says.
