Legal Question in Family Law in Missouri

My husband's ex girlfriend is now wanting child support on their 13 yr old daughter, we live in Missouri and she lives in Illinois. There has not been a court order for Child support. Will he be required to pay 13 yrs of back child support? Will they take in consideration he has 4 other children? Can he request visitation which he is currently denied, if he pays child support? how would we locate an attorney?

An attorney will need all of the facts before offering legal advice to your husband in this situation. However, generally speaking, he should not worry about being forced to pay 13 years of child support. Child support and parenting time with the child are two distinct legal issues which are often determined in the same legal proceedings, and your husband may obtain rights concerning the physical custody of the child either together with the child support court order or separately. The calculation of the child support and the terms concerning custody will vary according to which state has jurisdiction and which state law applies. I have handled a great number of domestic cases in the thirty-three years I have been practicing law. I have been licensed in both Missouri and Illinois for most of those thirty-three years. I would need to interview your husband, review any documents or pleadings he has, and conduct a modest amount of legal research prior to providing your husband with legal advice or representing him in any legal proceedings. Either you or your husband can call me to set up an appointment if you would like to discuss this further.
