Invention, Patent, is it mine if I am being divorced?

I want to patent my invention. I am in the midst of divorcing. The invention is a new idea, not one from the time my husband was still with me. Would it be considered marital property and be halved with my husband if I patent it before the divorce is final? I need to act quickly so I won't go bankrupt. He is not giving me any support and I want to keep the house.
