Legal Question in Family Law in Missouri

I was involved in a situation in 2005 where my daughter had to be placed in a relatives home for a short time, well they filed for legal gaurdianship of her which I did not fight because at the time I was facing legal trouble of my own and knew she would need someone to make decisions for her if things went bad for me. Well they did and I went to prison have since been released and have successfully completed parole and all the stipulations asked of me. The aunt and uncle that have my daughter have not let me see her,I have not seen her since 8-15-06, and am wanting her back. I pay child support every month and still have full rights to her, but want to know what it will take to get her back into my home? I know it will take awhile because she does not know me, and thats how they want it but I deserve to be her mother and they have said that they will fight me with everything they have, but to my knowledge they just have the gaurdianship in place. Is this likely that I can acheive this and bring her home?

I think that you will need to file a Petition seeking the termination of the guardianship upon the grounds that it is no longer necessary or in the best interst of the child. This can be difficult and expensive, but if you want your child back you must find a way. Good luck.
