Can kids of a divorced family decide which parent they want to live with at 12yrs old?

No. The law does not leave such important decisions to children. The Judgment entered by the Court concerning custody of the children shall continue to control until it is modified. Either parent can file a Motion to Modify with the Court when there are substantial and continuing changes in circumstances that make the original terms of the Judgment unjust and make it in the best interests of the parties or children for the original Judgment to be modified.
