Would I need a lawyer to child my children's last name if the the father and I both agree?

No one at the courthouse is going to help you with this.

You have to draft the pleadings, publish notice in proper publications, and conduct a hearing in front of the judge. Unless you know how to do these things, you will need to hire an attorney.
