Legal Question in Family Law in Missouri

leaving the country with children

I am divorced and have full custody of my two children. Their father has been in prison for the last eight years, and has filed a motion (from prison ) to modify his visitation rights. This has come about because I planning on taking them out of the country. I am positive that he will not agree to this, and I am going to petition the court. I was wondering if I have a leg to stand on in this matter.

Re: leaving the country with children

Obviously you need to hire an attorney and file a response to the Motion filed by your childrens' father. You may also need assistance complying with the relocation statute and obtaining the Court's permission for you to relocate with teh children in the event that their father objects to the proposed relocation. There are several important factors that the Court will consider, and you should discuss all of this with an attorney. You may call my office for a free telephone consultation.
