legal name change

i have a 7 yr old daughter who has my maiden last name and i did marry her father 4 yrs later but his name is not on her birth cert nor does she have his last name how do we go about changing that?

Normally it is a relatively simple matter to file a suit asking the circuit court in the county where you live to change your daughter's name. There are modest attorney's fees, filing fees, costs for publication in the legal newspaper, and perhaps a charge for the actual changing of the birth certificate. Also, under the circumstances you describe, you and your husband may be better served by seeking a "step-parent adoption". This would also involve a lawsuit and approximately the same costs as outlined above,but would have other legal results in addition to changing your child's last name to your husband's last name.
