How old does a teenager with separated parents have to be to choose which parent they want to live with?

The law does not allow a teenager to legally determine which parent the teenager lives with, instead the law considers this a parental decision. I would hope that your parents will be willing to talk with you about this and consider your thoughts and feelings when making the decision. If there is a Dissolution of Marriage (divorce) suit filed, then it is up to the judge to determine who gets custody. In most cases the parents agree and the judge approves their decision. In cases where the parents disagree, the judge considers all of the evidence, often including the wishes of the teenager, and then makes a decision based upon the judge's belief as to what is in the best interest of the teenager.
