How does it work? The simplest solution to this situation would be for one of you to obtain financing and take out a new loan to buy the other person out. You would pay off the existing mortgage, and both of you would sign a deed transferring ownership to you subject to the deed of trust held by the lender for security on the new loan. If this isn't possible, then you could both cooperate to sell the property and divide any proceeds after the existing loan is paid off. If you can't make anything work together, one of you could file a lawsuit in Partition and the Court will Order the property sold.
