Legal Question in Family Law in Missouri
What(if any) loopholes allow for legal polygamy in the usa?
1 Answer from Attorneys
since at least 1986 cohabitation between members of the opposite sex has not been proscribed by law. Cohabitation among those of the same gender has been lawful for more than a century. Therefore, a man and three or more women could live together and raise children. But, only one woman will be considered the lawful wife as far s the state is considered. In that way one will be living a polygamous lifestyle, but the state will neither sanction nor contest it.
As far as one woman wiht several men, it occurs all the time. Many women have children by several men, and get state aid for each one, plus themself. but, if she is lwfully maried to one of the men, he wil be presumed to be teh father of all children she bears during the marriage. This can be overset by a paternity suit against the biological father.
To date, there is nto means of legally marrying more thatn one person at time adn not be committing bigamy. The subsequent marriages can each be annulled by request.
