Losing the house during a divorce
I was informed that since my house is paid off, during our divorce, my husband has the option of making me sell the house, or refinance and pay him half of the money of the house, causing another mortgage for myself and my children. There is the option as well to stay in the house until certain triggers occur. When I asked what would happen if I was made to pay half of the house, and having difficulty paying the mortgage, I was told that I might have to move to lesser housing, townhouse, etc...I do not feel that it is in the children's best interest when they are established in a neighborhood, go to school two blocks away in a good district, that it seems that I am being punished for paying off my house and having a lot of equity in it. Is it true, the courts will put a mother and her children out on the street, just so the father can get half of the money in the house, even if it makes it a hardship on the mother and children?

Can the father afford to purchase mother's half interest in the house? Perhaps, since the children are established in the area, they would be better served to live in the house with Dad and Mom could move to more affordable housing using the money from Dad.
