Lying in a divorce case

My now x-husband got a divorce from me without me knowing it by telling the judge that he had no idea where I was or how to get ahold of me. That would have been o.k. if we did not have 2 childeren involed in this case. He got the kids because the kids were never asked who they wanted to live with. I can prove that he knew how to get a hold of me and that he knew where I was. I have been an active part of my kid's life, but now he is trying to stop that also. I guess my question is what can I do about this? I have talked to my kids and they would like to come live with me but at this time that can't happen because my x-husband won't allow it. (my childern are 13 and 14 now)So if you can help me that would be great i just need to know what I can do and how to go about doing it. I want me kids, and I would like to see him pay for lying to the court.

if the divorce was granted less than one year ago, you may be able to have it set aside by proving that your ex committed fraud upon the court. If the divorce is older than one year, then you may be limited to filing a Motion to Modify. In either event, it will require a substantial expense of time, effort and money on your part.
