Legal Question in Family Law in Missouri

maintenance support

Is there any kind of time limit on how long someone has to pay maintenance to an ex-spouse? Or any kind of changing circumstances that could get it stopped?

Re: maintenance support

In Missouri the law requires that the judgment providing for the payment of maintenance state specifically whether that maintenance order is modifiable or non-modifiable. If it is modifiable then you can file a Motion to Modify the existing court order if there are continueing and substantial changes in the circumstances of the parties since the entry of the order which make that order unjust and not in the best interests of the parties. An example of this would be where the respective incomes of the parties have changed drastically, or the needs of one of the parties have changed drastically, although there are many other possible scenarios where a modification might be had. If the order is non-modifiable, or if no changed circumstances exist, then maintenace terminates upon the death or remarriage of the person receiving the maintenance. I hope that this response has been helpful for you.
