Legal Question in Family Law in Missouri
I was married in MO and had a set of twins now 16 and a 17 yrs old. My ex made sure
i had no contact with them over the years. Last yr we found them on facebook came for a visit and decided to move here.My new wife and family moved from MA to MO to be reunited with him and his two brothers. He moved in with us after his mom kicked him out as well as other significant issues he was having with his step dad and needs to transfer schools. He wont be graduating till hes 19. I wasnt married at the time of his birth so im not on his birth certificate. And I dont have any legal custody only visitations per the divorce. What is the easiest way per MO law to get him enrolled in school where we live?? Unfortunately we dont think hes mom will voluntarily sign anything. Can he appoint his dad as a legal guardian for school purpose? We need to transfer him asap. Thank You

If I understand you correctly, your visitaitonorder is from a Missouri Court. If that is the case, paternity has already been established. You can seek a modifction of the custody Order within that Missouri case. Your Son, can tell the court and the Guardian Ad Litem that he wants to live with you in Missouri and go to school here. That will carry some weight.
If your visitaiton Order comes from outside Missouri, there may still be an interstate compact that honors that Order in Missouri, but you will have to take some extra steps to accomplish what you want. You should consult directly with an attorney in your area ASAP. Many offer a free or low cost initial conultation.
