Legal Question in Family Law in Missouri

military retirement

I pay my ex-wife 42% of my retirement as stated in my divorce decree.It doesn't say it's not modifiable, it does say neither party is in need of maintenence from the other.So since we were separated for 7 or those 17 years she was granted, is it possible to get that down to the actual years we were together, during our separation she lived with a man and had a child, we got back together and I adopted that child, so I have proof of separation.I never attended the hearing nor did I get a attorney so everything she ask for she got.I just want it fair.Just hope for a little information

Too bad you decided not to hire an attorney. There is a virtual explosion in the number of people, like you, who elect not to hire an attorney when they would be much better off to do so. Many, if not most, of these people will be looking for an attorney's advice or even hiring an attorney at greater expense once they realise the reality of ther situation. I know of no way to help you. In Missouri the division of marital assets is based upon the length of the marriage, not the length of timeyou actually spent together. I hope that the next time you are in need of legal services you hire an attorney.
