Missouri Child support
I was divorced in Missouri in 1993 My ex- wife has filed a modification to support . My question is, my oldest daughter is 19 years old and a college student, My other duaghter is 18 and a high school senior. Am I required to pay support afer 18 and graduation from High School?

Thank you for your inquiry. Kansas and Missouri laws are different regarding child support. In Missouri child support may be imposed to the age of 22 as long as certain requirements of the laws are followed. The child must be enrolled in a higher education facility, maintain a grade point average, attend continuously and one break is allowed. However the costs of that education may be taken into consideration in calculating child support. I suggest you contact an attorney if the mother of the child has filed a motion to modify. After service you have 30 days to respond.

The Missouri child support statutes provide that your obligation to pay child support will continue past the child's 18th birthday if the child enrolls full time at an institution of higher learning by Oct. 1 following graduation from high school, takes at least 12 credit hours (or 9 if the child works a certain number of hours per week), progresses towards completion of the degree requirements, and provides the non-custodial parent with school records showing what classes the child has taken and will take on a semester by semester basis. This is a general paraphrasing of the statute only. Also, trial courts are known to bend the strict application of the law in the child's favor regularly.
