Legal Question in Family Law in Missouri
In Missouri, St. Louis County.
My daughter has been married for 2 years. They have no children from their marriage but she and he husband have children from previous marriages.
The home is in both of their names even though the mortgage is in his name only. Her car is in his name.
He has assaulted her, pushed her. Police were called once. He just retained an attorney to file for divorce.
What are the general guidelines over distribution of property when he marriage is short-lived?
She makes her own income (small). Is she entitled to Maintenance for a couple of years?
For the house? For the car? Are these just matters that have to be hammered out or are their clear rules about this?
Thanks in advance.

There are statutes, Supreme Court Rules, Circuit Court Rules, various Federal laws that may apply, case law, and other sources of law that address the topics you bring up. That is a major reason why your daughter should have the best legal representation she can afford. If she lives within a jurisdiction where I regularly practice, I might be able to offer her my services for a reasonable fee. I have handled hundreds of such matters over the last thirty-five years. No matter what, she should consult with an attorney.
