Legal Question in Family Law in Missouri

Missouri- I have been told by my ex-girlfriend that her 3 year old baby could be mine. I agreed to take a paternity test and once I made arrangments, she refuses. The father's name on the birth certificate is currently her husband and is also going through a divorce. He is a citisen of Australia nand is living there now and not supporting the child. What are my rights?

You can Petition the Court for an Order of Paternity. her husband is the presumed father, so you would probably ahve to get a court to order the Mom to surrender the child to a DNA test. This is something you should consult directly with a family law attorney before attempting.

You may be able to file a Motion to Intervene in the pending Dissolution of Marriage proceedings and be made a party to those proceedings. Then, you can file a Motion to Determine Paternity and obtain a court Order for the DNA testing. If you are not the father, you can dismiss your pleadings and be done with it.
