Mo. mandate obligation to pay tuition expenses

My decree does not have language about post secondary school. I have two children, one is currently in college the other is an 11th grader in high school. I would like to modify decree to include help with college tuition for children. My ex helped pay for the first year but has stated that he is not obligated to continue paying. How likely would it be that a judge would order my ex to help with college expenses? In New Jersey where my children and I live it is the obligation of the parents to help pay for post secondary school. I am also wondering if I can change the venue to NJ since myself and children have been living here for about 13 years?

I believe that you could file a Motion to Modify your original decree here in Missouri and stand an excellent chance of having a Judge require your ex to contribute to the higher education expenses, especially if your ex is financially able to do so. Also, we do have statutes in Missouri which would allow for the Missouri Court to transfer the case to another court, another venue or perhaps even another state's court under certain circumnstances. It is usually done where both parties have moved and consent to the transfer, but it is possible even if your ex does not consent. The real question would be whether you want to spend the money needed to give it a shot. I have handled hundreds of modifications mostly in the counties surrounding St. Louis.
