Modification of custody by father

My husband is seeking modification of custody for his daughter (11). Currently has visitiation but since 9/2000 has modified to joint custody to every other week, by verbal agreement with child's mother. Continued to pay child support, but daughter actually with him 20+ days each month. Also exclusively pays for private school education. Ex-wife has another daughter (15) whom he raised but never legally adopted currently living full time with us. Ex ready to reverse back to old arrangement, we are seeking joint physical and legal custody, older daughter wants emancipation so she can live with us. Any thoughts?

I wonder how other attorneys will respond to your strikingly unusual question "Any thoughts?"

My response is simply that your current husband should consult with competent legal counsel immediately if he has not already done so. If he is currently represented, then I believe that his current lawyer should answer any questions you might have. If not, the facts contained in your question suggest to me that there may be sufficient grounds upon which to obtain a modification of the pre-existing Court Order at least concerning your husband's natural daughter.
