mortgage liability in a divorce

Husband moved out of home for another woman. Wife wishes to move out of home and rent because home is too much upkeep. Home mortgage is in wife's name, but husband's name is on the deed. Can wife simply move out and leave the mortgage responsibility for husband?

Your question states that the wife is on the mortgage. Obviously, she can not just stop making the payment without suffering the consequences. If wife wants to file for a divorce, she can also file a PDL Motion asking the Court to Order husband to pay wife temporary maintenance to help make the mortgage payments until the house is sold.
