Legal Question in Family Law in Missouri

Moved to another state, what are my rightds regarding child support modification

My ex-wife and I divorced in Illinois. She lives in Missouri with our 2 minor children. At the time of our divorce I agreed to pay $4000 per month in child support- aproximately 65% more than the guidelines. The support I provide pays 100% of my ex-wife's mortgage, car payment, utilities, food, clothing, etc. Additionally, her personal spending is frivilous and she is putting nothing towards the children's future. I am remarried and live in Texas. Illinois courts have ordered that cases with my ex-wife be moved to the Missouri county in which my children reside since I now reside in Texas. I know there is a MO law that supports a modification in support if the difference is 20% of what the guidelines are. I am paying well over 20% of the MO guidlines, plus paying 100% of my children's medical benefits. My ex-wife is employed in Missouri as well. Is a modification likely for me? Thanks!

From the facts stated in your question it would appear that you have an excellent chance for your Illinois Judgment to be modified in Missouri. Personally, I would want to do a certain amount of legal research before I gave you a definite answer. There may be other cases with facts similar to yours which have been decided by our court of Appeals or the Supreme Court, and I would want to be sure as to their holdings. If your ex and the children reside in the St. Louis area, I may be able to provide legal services for you. I have been practicing law for over twenty-five years and I do a substantial amount of family law work. You may call me for a free telephone consultation at 314-727-2822.
