Moving out of state.

I wish to move with my child from MO to CO where my fiance lives. My child lives with me, however I share joint custody with my ex. How can I best ensure that my child is allowed to move out of state?

In Missouri we have a "Relocation Statute" which sets out the legal requirements and procedures in a situation like yours. Basically, you must send the other parent a letter including very specific information. Then, the other parent has a short amount of time to file something in Court if he or she objects to the relocation. Then, a Judge will determine whether you are allowed to move with the child. Usually, you will be allowed to move so long as appropriate adjustments are made in the parenting plan to assure substantial amd meaningful contact between the other parent and the child. You may want to consult with an attorey to be sure this is handled correctly the first time.
