Legal Question in Family Law in Missouri
My nephew's girlfriend filed an application for child support and received an administrative order against him ordering him to pay $677 a month for one child. She lied on the app and said she was not aware that he had another child in another state and that he is paying $624 a month for that child. DFS refuses to amend the order when he requested an amendment. My question is what does he need to file with the court to get the support amended and get a parenting plan in place. Also a St. Louis City Judge signed the administrative order, but my nephew lives in St. Louis County. Should he file a Motion for Custody and in what jurisdiction. The mother lives in the City of St. Louis.
1 Answer from Attorneys
If the child lives in St. Louis City, that is the proper Court for the Support Order. If the amount is inaccurate, his attorney needs to file either a Motion reconsider or a Motion to amend. Child support enforcement, nor any other agency can change the amount from what the Court Orders.
