Legal Question in Family Law in Missouri

My niece in Missouri husband just moved out after two years, stating he will doesn`t love her anymore and threated to take one year old bilogical son and two adopted boys which belonged to my nieces cousin on her mother`s side just because he can because the kaw says whomever files first get temporay custody until court date, this does not sound right to me
