I am an unwed father of 3 paying child support.Although I am listed on all birth certificates do I still need the above filing? My children's mother has been on drugs/in & out of rehab. My children are with her mother and I want custody. Please help as to the steps I need to take.My visitation has been per the grandmother's schedule.

Your post does not really give us very complete information. Have you ever been to court for any of these three children? Or, did the State of Missouri conduct an administrative determination of paternity and order you to pay child support? How does the Grandmother enter ito this legally? Does she have custody of the children? If you have not been to Court, then I must understand that you have absolutely no rights of visitation or temporary custody of these children. Only a court may grant you these things. If you want custody as you say, then you will have to file a Petition in Court and proceed with litigation. I have handled many custody battles in Court and I can tell you that they can become quite expensive depending upon a variety of factors. If there are any allegations of abuse or neglect by a parent then the Court must appoint an attorney to represent the children's legal interests, and that attorney's fees must be paid by the parents in additon to thier own attorney's fees. In any event, you may call me at the office if you would like to discuss this further. If I can not helpo you myself, I may be able to refer you to someone who can do so.
