Legal Question in Family Law in Missouri

paternity

I am wondering how I can prove paternity after death. The situation is the father of my grandson committed suicide last year, we've been trying to get paternal death benefits for my grandson and we don't know how to go about doing it. My grandson is only 2 years old and deserves this money. Paternity was never verified as he died before it was done, can't they do something with the tissue of the autopsy or something to prove the paternity. If so how do we go about doing it.

Re: paternity

The standard test now is by DNA analysis, and there have been case of posthumus testing. It may also be possible to "prove up" paternity if the decedent admitted paternity while he was alive. I have never handled such a case myself, but you may be able to find an experienced attorney through the internet or through a Lawyer's Reference service. Good luck.
