Legal Question in Family Law in Missouri
I am paying on my son's hospital and doctor bills. My ex is responsible for these in our divorce decree but because I took our son I am the one they expect to pay, so I am paying monthly now on these. My ex has not contacted them to make payment arrangements. I want to know if I have to have these bills paid off before I can take my ex to court or can the courts in missouri tell him to pay them and pay me back what I have paid so far? It also says in my divorce decree that who ever is at fault will pay the lawyer fees. Thank you for your help.

Your divorce decree does not prevent a creditor of yours from collecting from you. As you mentioned, you can bring a suit to sue your ex for apportionement or reimbursement of wah tyou have paid. You may sue now for what you have already paid, but you may have to do it again if the creditor comes after you again. You may bring a request for a finding of contempt in your divorce case, and the court there may require him to reimburse you, and possilby put other threats on your ex(that a regular civil court cannot) if he does not pay the remainder of the bill, or hold you harmless for your paying the rest of it. Talk to yrou divorce attorney. I suspec tthey will want you to go the second route as you can get their fees paid by the other side.
