Phone Taps
My wife and I are thinking of getting custody of her two youngest children. Her ex-husband claims, that he has phone taps of conversations of her and other individuals while they were married. He claims that he can use them as evidence in a custody hearing to prove her unfit and irresponsible. From my knowledge, they contain admissions of her being unfaithful to him. I told her that, phone taps are inadmissible in court and can not be used as evidence. Also, it has nothing to do with care and providing for the children. What I would like to know is, what are the laws conserning this area? Also could you interpret for me MO. Rev. Stat. 542.402 and MO. Rev. Stat. 542.418. Would it be in our favor to use in any form? You will need to contact an attorney in Montana who can tell you what the wiretapping laws there are and to interpret those statutes for you. Legal research is very time-consuming and is beyond the scope of this forum. You may have to pay an attorney to do this for you.
