I'm currently pregnant by my ex boyfriend. If I get married will my husband be my daughters legal father? Can I give my child my last name? I am very confused on my rights. Please help!

If you're married when you give birth, your husband is presumed to be the father. That presumption can be overturned by a paternity suit. But, not without the father claiming his rights (and obligation to pay child support.)

If you marry before the baby is born, the law will presume him to be the legal father with all of the rights and duties that go with it, even though you know that he is not the biological father.
