Can I Get Primary Custody Back?

My exboyfriend and I have already have a parenting plan in place where he is the primary care giver. We have joint custody, but based on lies, etc, that he said about me, I was forced to give him primary custody. How hard is it to have that changed? Can it be changed? If we were to get back together and possibly get married, does that make us both the primary care giver again? If we got divorced, would a new parenting plan be put in place? Any information would be great, thanks!

Based upon the facts stated in your post my understanding is that therre has been a paternity suit in which a Judge determined your ex-boyfriend to be the father of your child and awarded custody as you set forth. If this is true, then you can file a Motion to Modify the Judgment, and seek a change in the custody arrangements if there are substantial and continueing changes in the circumstances of the child or the custodial parent which make the terms of the existing Judgment unfair and it is in the best interest of the child for those terms to be changed. If this is true in your case then you need to consult with, and hire, an attorney.
