Legal Question in Family Law in Missouri
My ex recently went on short term disability, siting that his physical condition was preventing him from performing his job. He is a technician, so carrying heavy ladders, lifting, etc. has been a part of his job for the past 11 years. After being on disability for 3 months, he quit his job stating that he cannot perform due to his physical condition (pinched nerve in shoulder, knees, etc.). Now, he works for his girlfriend making just a little more than minimum wage and has requested a modification of child support!!! What can I do? Is this legal? If the court approves this based on his new income, I fear my child support payments will be drastically reduced. Also, he has filed a motion to change the venue to the State of Georgia. Please advise.
1 Answer from Attorneys
Generally, venue and jurisdiction will stay either where the child lives, or where the original Order was issued. Unless there is a change in circumstances of the child, the support amount will stay the same. I cannot advise you as to Georgia law. You will need to ask A Georgia attorney.
Good luck
