Legal Question in Family Law in Missouri
Reducing child support
I have basically lost my job and had to take a job in another state for less than what I was making. 50,000 is my base pay and 1400.00 for 3 children is what I am paying now. My debt including child support is around 4200. I am sinking fast and need to find out if it is worth my time to retain a attorney????

Re: Reducing child support
It is not possible to answer your question with only the information you have provided. Generaly speaking, you will need to consult with an attorney here in Missouri and calculate a new Form 14 to see whether it would make sense to hire the attorney to pursue a Modification of the existing child support Order. The attorney will need to know the current gross monthly incomes for both you and the other parent. The number of children subject to the Order. Any other children for which either parent is financially responsible. Any day care costs. Any cost of health insurance coverage for the children subject to the Order. And, how much time the non-custodial parent gets the children in order to calculate any applicable adjustment. If your child support obligation would be reduced by 20% you will be able to make a prima faci case for a Modification. Then, you can consider the attorney's fees, court costs, possible risks involved and so forth to decide whether or not to proceed. If the case would be in the Eastern part of the state, I might be able to help you myself. You may call me for a telephone consultation if you would like.
