Ex Relocating and Wants to Take Kids
My ex and I share joint legal custody of 2 daughters - ages 14 and 10 - with my ex having primary physical custody. Recently I learned that my ex would like to move to another state with her boyfriend and wants to take the kids with her. My 14 year old has expressed nonconformity with her mother's intentions, and I don't feel as though it's in the best interest of my kids either. My ex has abided by the legal requirements of informing me of her intentions, new residence, etc. What recourse, if any, do I have in this matter? And under what timeframe am I operating within?

My recall of the relocation statute is that you have sixty days from the date of the notice of relocation provided by your ex to file a Motion in Court objecting to the relocation. I have handled several of these, at various times representing one or the other party, and the results are always very "fact specific."
