Legal Question in Family Law in Missouri
Served court papers today from ex-husband re: child support modification. He's behind approximately $7,300 in child support, QUIT his $100,000+ a year job to get out of paying child support, is not providing insurance coverage per the divorce decree (now I'm getting the penalty on my income taxes), basically doesn't help pay for anything at all. I don't know if I should hire an attorney for this or not? Does he actually have a case with this? I would have agreed to a lower amount when he "lost" his job (as he says), but he never asked. Now this.

You need to at least consult directly with an attorney in your area. Your ex probably does not have a basis to have the Order amended retroactively. He probably will continue to owe the back support. His filing may provide you a cheaper means of having him found in contempt for not paying and not providing insurance. There are just too many unanswered variable to give you a simple Yes/No answer given your basis description of the general facts. You need advice specific to the particular facts of your situation. Many attorneys offer a free or low cost initial consultation. Gather your documents and go see one. If you had counsel during the divorce, get your file from them.
