Legal Question in Family Law in Missouri

Served with a Notice to Debtor of Exemptions from Levy

I have received a 'Notice to Debtor of exemption from Levy' letter, Mo. R.S. 513.445, with a case number and return date of 06/20/02. I do not understand what it is for. It is from my ex-wife from money owed in our divorce. She is looking for $4000.00. The paper does not have a phone #that I could call to ask questions. It was dropped off at my work and put in my mail box. I guess my questions are:

What is it for?

What do I do?

What can the court take or garnish?

Can the court start garnishing my wages before the return date?

Do I have to go to court?

What are my options?

Who can I call?

Re: Served with a Notice to Debtor of Exemptions from Levy

It sounds to me like you have either had your wages garnished or an execution has been served aginst some of your assets such as a bank account perhaps. In any event, there are often quite detailed explanations included on the reverse side of the Notices. Or, I would suggest that you call or visit the Sheriff's department in the county where you reside or work. Someone there will probably be able to explain exactly what is pending in your case, and what you need to do to protect any of your assets or income which may be exempt from execution. Good luck.
