Shared Child Support

My child's father lives in California; I live in Missouri. He was ordered by the court to pay child support for our son, but the calculation of support included payment for a child that was conceived in his previous marriage. Paternity was established for my child, but not the other child, whose paternity is in question. Is there something that can be done to establish paternity on the child in question and modify the payments made to me if the child is not his?

Where was the Court that Ordered the child support? Are you saying that there is a Court Order which includes some calculation of child support for a child that was born to the father of your child while he was married to another woman? This sounds right, since in Missouri the husband is presumed to be the father if he is married to the mother when the child is born. In any event, if that mother or the father of your child have questions about paternity I suppose that they could file a Petition seekeing a determination or asking that any previous Orders be set aside. All of this response is highly guarded since the facts are not clearly stated inyour post and there are facts which might be important not mentioned at all. I would suggest that you talk with your attorney or consult with an attorney about this.
