my sister in law has filed for divorce from my brother but the birth date for him is wrong is it still legal?

That error will need to be addressed. But, it will not likely cause the Divorce Petition to be invalid. You might help your brother get with a family law attorney, in his area, soon. He needs to address dome issues ad soon ad he can.
